Muna Osman Provincial Offences Defence
FAQ

Frequently asked questions

Plain-language answers to the questions Muna hears most often about Provincial Offences and Highway Traffic Act charges.

Speeding & Photo Radar

Is fighting a speeding ticket worth it?

Usually yes. The fine is rarely the real cost — the real cost is the insurance increase over three years and the demerit points on your record. Even reducing a charge to a lower-speed offence (or a non-moving violation) can save a meaningful amount in insurance.

What about photo-radar (ASE) tickets?

Photo-radar tickets are issued to the registered owner, not the driver. They carry no demerit points. However, the fine still has to be addressed and the certificate of offence has to be checked for accuracy. Don't ignore one — it can lead to plate-renewal denial.

Careless & Distracted Driving

What's the difference between careless driving and dangerous driving?

Careless driving is a Highway Traffic Act offence (provincial). Dangerous driving is a Criminal Code offence. Both can arise from the same incident.

Muna handles careless driving and other Provincial Offences. If your matter is criminal, Muna can refer you to a lawyer.

Stunt Driving & Major Charges

I was charged with stunt driving. What should I do first?

Call Muna immediately. Stunt driving carries a roadside 30-day licence suspension and a 14-day vehicle impound before any court hearing. The charge itself, on conviction, brings a 1-to-3-year suspension, a fine up to $10,000, and serious insurance impact.

Acting fast preserves the best defensive options.

Suspensions & Demerit Points

My licence is suspended. Can I drive to work?

No. There is no general 'driving for work' exception under Ontario law. Driving while suspended is a charge in itself and can multiply your problems. If you need to keep driving, talk to Muna about whether there's a path to reinstatement.

Court Process

Do I have to attend court?

When Muna is your representative, she attends court for you on most Part I matters. For some Part III matters and most trials, you may be required to attend. Muna will tell you exactly what's needed before each appearance.

How long does the process take?

Most matters resolve within a few months. Trials and complex charges (stunt, careless causing bodily harm, etc.) can take longer. Court schedules vary by jurisdiction. Muna will give you a realistic timeline once she sees the disclosure.

General

Should I just pay the ticket?

Almost never. Paying a ticket is a guilty plea — it puts the charge on your record, the demerits on your licence, and the insurance increase on your renewal. Even small tickets can cost thousands over three years in higher premiums.

Before paying anything, talk to Muna. A free consultation costs you nothing and often saves far more than the fine.

Can you guarantee my charge will be withdrawn?

No paralegal can guarantee any specific outcome. The result depends on the facts, the disclosure, the officer's notes, the prosecutor, and the court. What Muna can guarantee is a careful review of your disclosure, an honest opinion of what's possible, and clear communication every step of the way.
